Terms of Service

1. Acceptance of Terms
By installing or using Cartalyst ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you are installing the App on behalf of a Shopify store, you represent that you have the authority to bind that store to these Terms. If you do not agree to these Terms, do not install or use the App.
2. Description of Service
Cartalyst is a Shopify cart intelligence application that uses Shopify Web Pixel events and order webhooks to generate aggregate product-level reports. The App identifies:
- Products added to cart but not purchased
- Products removed from cart before checkout
- Storefront searches with no matching results
- Products frequently added to cart together but rarely purchased together
The App does not recover abandoned carts, send marketing emails, or store customer personally identifiable information (PII).
3. Eligibility and Registration
To use the App, you must have a valid Shopify store and install the App through the Shopify App Store. You are responsible for maintaining the confidentiality of your Shopify account credentials. The App is available only to merchants who can form legally binding contracts under applicable law.
4. Fees and Payment
The App is offered with a free tier and optional paid premium plans. All fees are processed through the Shopify App Store billing system. By subscribing to a paid plan, you authorise Shopify to charge the applicable fees to the payment method on file with your Shopify account.
- Free tier: basic cart leak reports with limited data history
- Premium plans: advanced reports, extended data history, and priority support at the listed price
Fees are non-refundable except as required by applicable law or as expressly stated in the plan terms. We reserve the right to change our pricing with 30 days notice, communicated via the Shopify App Store listing.
5. Appointments, Limitations, and Restrictions
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to reverse engineer, decompile, or extract the source code of the App
- Use the App to collect data from Shopify stores you do not own or have authorisation to manage
- Interfere with or disrupt the integrity or performance of the App or its infrastructure
- Use the App in a manner that exceeds reasonable request volume (excessive API calls)
6. Intellectual Property
The App, including its code, design, branding, and underlying technology, is the intellectual property of Cartalyst and its licensors. These Terms do not grant you any ownership rights in the App. You are granted a limited, non-exclusive, non-transferable license to use the App during the term of your subscription.
Shopify is a trademark of Shopify Inc. Cartalyst is an independent application and is not affiliated with, endorsed by, or sponsored by Shopify Inc.
7. Data Ownership and Use
You retain all ownership rights to your store data. Cartalyst is granted a limited license to access and process your data solely for the purpose of providing the App's reporting features as described in the Privacy Policy. Upon uninstallation, your data is deleted within 30 days.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Cartalyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:
- Your use or inability to use the App
- Any changes to the App or its features
- Unauthorised access to or alteration of your data
- Any conduct or content of any third party on the App
Our total liability for any claim arising from these Terms or the App shall not exceed the total fees paid by you in the twelve months preceding the claim.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, secure, or that all cart leak signals will be identified. The reports generated by the App are informational and do not guarantee specific revenue recovery outcomes.
10. Termination
You may discontinue use of the App at any time by uninstalling it from your Shopify admin. We may suspend or terminate your access to the App if you breach these Terms, if your Shopify store is inactive for an extended period, or as required by applicable law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via the Shopify App Store listing or by email to the store owner. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Romania.
